The Constitution Day Mandate

The United States Department of Education implemented, on May 24, 2005, the Constitution Day and Citizenship Day requirement, applicable to all educational agencies that receive funding from the U.S. Department of Education. (US Dept. of Educ., Notice of Implementation, 70 Fed. Reg. 28727, 5/24/05.)

This Notice implements a provision of Public Law 108-447, in section 111(b). (Consolidated Appropriations Act, 2005, Public Law 108-447, December 8, 2004, 118 Stat. 2809, 3344-3345, (pp. 536-537 of pdf).)

All such educational institutions, whether school districts or universities, must provide programming on the U.S. Constitution on September 17. If the 17th lands on a weekend, as it does this fall, schools must offer the programming the week before or after. Senator Robert Byrd of West Virginia is responsible for this requirement.

This Blawg will be dedicated to understanding the new federal mandate, effective this September 17, 2005, for all educational institutions which receive funding from the US Department of Education, or in other words, almost all of them, to have programs on the U. S. Constitution on Constitution Day.
